Terms And Conditions
Terms governing the use of FootyPass and its ticket marketplace.
1. Introduction
These Terms and Conditions govern access to and use of FootyPass and its football ticket marketplace.
1.1 Acceptance of These Terms
By creating an account, purchasing a ticket, listing a ticket or otherwise using transactional FootyPass services, you agree to these Terms.
1.2 Eligibility to Use FootyPass
You may use FootyPass only where you are legally capable of entering the relevant transaction and satisfy applicable account and verification requirements.
1.3 Scope of These Terms
These Terms apply to FootyPass accounts, listings, orders, ticket delivery, marketplace transactions, buyer protection and seller services.
1.4 Other FootyPass Policies
These Terms should be read together with applicable Privacy, Cookie, Refund, Buyer Protection and Seller policies published by FootyPass.
1.5 Statutory Rights
Nothing in these Terms removes any consumer or other legal right that cannot lawfully be excluded or restricted. Mandatory applicable law will prevail.
2. About FootyPass
FootyPass provides technology and marketplace services for discovering football events and buying or reselling available tickets.
2.1 Marketplace Service
FootyPass operates an online marketplace through which eligible sellers may offer tickets and buyers may purchase available listings.
2.2 Secondary Ticket Marketplace
Tickets available through FootyPass may be resale tickets rather than tickets supplied directly by an event organiser or primary ticket issuer.
2.3 Event Organisers
Unless expressly stated otherwise, FootyPass is independent from football clubs, stadium operators, leagues, competitions and primary ticket issuers.
2.4 Platform Availability
FootyPass may modify or temporarily suspend features where reasonably required for security, maintenance, fraud prevention, legal compliance or improvement.
2.5 Ticket Availability
The display of an event does not guarantee ticket availability. Listings may be added, purchased, withdrawn or become unavailable.
3. Definitions
The following definitions explain important terms used throughout these Terms and Conditions.
3.1 Buyer
Buyer means a person who places or completes an order for one or more tickets through FootyPass.
3.2 Seller
Seller means a person or business that creates, supplies or fulfils a ticket listing through FootyPass.
3.3 Ticket
Ticket means the admission right offered through a listing, including supported mobile, electronic or transferred admission credentials.
3.4 Listing
Listing means an offer describing one or more tickets, including relevant event, quantity, location, price, delivery and restriction information.
3.5 Event
Event means the football match or other sporting, recreational or cultural event to which a ticket provides admission.
4. Eligibility
Transactional FootyPass services are subject to eligibility requirements intended to support lawful and secure use.
4.1 Minimum Age
Users entering ticket transactions or receiving seller payouts must be at least 18 years old unless FootyPass expressly permits another lawful arrangement.
4.2 Legal Capacity
You must have the legal capacity and authority required to enter transactions performed through your account.
4.3 Supported Locations
Some services, payment methods or payouts may be restricted according to location, payment-provider availability or legal requirements.
4.4 Previously Suspended Users
A suspended or terminated user must not create another account for the purpose of evading an account restriction.
4.5 Compliance Requirements
Use of certain services may depend on identity, payment, fraud, sanctions or other reasonable compliance checks.
5. Account Registration
Certain FootyPass services require a registered account containing accurate and current user information.
5.1 Accurate Registration Information
Users must provide accurate, current and complete registration information and must not impersonate another person.
5.2 One Account Per User
Unless otherwise permitted, a user should maintain one personal account and must not use additional accounts to evade marketplace restrictions.
5.3 Email and Contact Details
Users must maintain contact details through which FootyPass can provide transaction, ticket delivery, security and account communications.
5.4 Updating Account Information
Material account information must be updated when it changes, particularly details relevant to identity, payments, delivery or seller payouts.
5.5 Account Ownership
Accounts are personal to their registered users and must not be sold, transferred or shared in a manner that undermines verification or security.
6. Account Security
Users are responsible for maintaining the security of their FootyPass accounts and for taking reasonable precautions against unauthorised access.
6.1 Account Credentials
You must keep passwords, verification codes and other authentication credentials confidential and must not deliberately disclose them to unauthorised persons.
6.2 Unauthorised Access
You must notify FootyPass promptly if you reasonably believe that your account has been accessed or used without your permission.
6.3 Security Verification
FootyPass may require additional authentication or verification before allowing sensitive actions such as account changes, listings, payments or payouts.
6.4 Suspicious Activity
FootyPass may temporarily restrict an account where activity reasonably appears unusual, fraudulent or inconsistent with normal account use.
6.5 User Security Responsibilities
Users should use reasonable security measures, keep devices and contact accounts secure and avoid acting on suspicious messages claiming to represent FootyPass.
7. Identity and Seller Verification
FootyPass may perform identity, seller, payment and compliance checks to protect users and maintain marketplace integrity.
7.1 Identity Verification
FootyPass may request information or documentation reasonably necessary to confirm a user's identity before enabling or continuing certain services.
7.2 Seller Verification
Sellers may be required to complete additional checks before creating listings, receiving earnings or requesting payouts.
7.3 Verification Information
Information supplied for verification must be genuine, accurate, current and must relate to the person or business operating the relevant account.
7.4 Payment and Payout Checks
FootyPass or its payment providers may perform checks connected with payment methods, payout destinations, fraud prevention and applicable financial compliance.
7.5 Failure to Complete Verification
FootyPass may restrict listings, purchases, withdrawals or payouts where required verification has not been completed or where submitted information cannot reasonably be verified.
8. FootyPass Marketplace Role
FootyPass provides marketplace infrastructure connecting buyers and sellers while also performing platform, payment, security and buyer-protection functions.
8.1 Marketplace Operator
FootyPass operates the online marketplace and provides technology through which ticket listings may be published, discovered and purchased.
8.2 Relationship Between Buyer and Seller
Unless FootyPass expressly identifies itself as the seller of a ticket, the seller is responsible for supplying the ticket described in the listing. This does not limit any responsibility imposed on FootyPass by applicable law.
8.3 Not the Event Organiser
FootyPass does not control the scheduling, operation, admission policies or performance of events organised by independent clubs, venues or event organisers.
8.4 Marketplace Controls
FootyPass may review, restrict, suspend or remove listings and transactions where reasonably necessary to enforce marketplace rules or protect users.
8.5 Legal Responsibilities
Nothing in this section excludes responsibilities that FootyPass, a buyer or a seller has under applicable consumer, ticket-resale or other mandatory law.
9. Buyer Responsibilities
Buyers must provide accurate transaction information, review listing details carefully and use purchased tickets lawfully.
9.1 Reviewing the Listing
Before ordering, buyers should review the event, date, ticket quantity, seating or standing information, restrictions, delivery method and total price shown.
9.2 Accurate Buyer Information
Buyers must provide accurate contact and delivery information where required and must keep relevant details accessible until the transaction is complete.
9.3 Event Entry Requirements
Buyers are responsible for checking applicable venue or organiser entry requirements, including identification, age, accessibility or attendee-specific requirements.
9.4 Ticket Handling
After delivery, buyers must take reasonable care to protect ticket files, barcodes, mobile credentials and transfer links from unauthorised disclosure or use.
9.5 Reporting Problems
A buyer who experiences a material ticket or delivery problem should notify FootyPass promptly and provide reasonable information needed to investigate the issue.
10. Seller Responsibilities
Sellers are responsible for the tickets they list and must provide accurate information, valid tickets and timely delivery.
10.1 Authority to Sell
A seller must have the lawful right and authority to offer each ticket listed through FootyPass and must comply with applicable restrictions on resale.
10.2 Accurate Listing Information
Sellers must provide accurate and complete information about the ticket, including material seating, quantity, restriction, delivery and event details.
10.3 Valid Tickets
Sellers must supply genuine tickets capable of providing the admission described in the listing and must not knowingly supply cancelled, duplicated, invalid or previously used admission credentials.
10.4 Timely Delivery
Sellers must deliver or transfer tickets within the required timeframe and follow reasonable delivery instructions communicated through FootyPass.
10.5 Cooperation With Investigations
Sellers must reasonably cooperate with FootyPass when investigating delivery problems, invalid-ticket claims, chargebacks, suspected fraud or other transaction disputes.
11. Ticket Listing Rules
Every ticket listing must comply with FootyPass marketplace rules and applicable requirements governing ticket resale.
11.1 Complete Listings
Sellers must provide all information reasonably required by FootyPass to identify the ticket and allow a buyer to make an informed purchase.
11.2 One Accurate Listing
A seller must not create duplicate listings that could result in the same ticket being sold more than once.
11.3 Correct Event
Tickets must be listed against the correct event, fixture, date and venue so far as those details are known when the listing is created.
11.4 Listing Availability
A seller must remove or update a listing promptly if the advertised ticket is no longer available for sale.
11.5 Compliance With Resale Rules
Sellers must comply with applicable laws and lawful ticket-resale restrictions and must provide information required for FootyPass to operate the marketplace lawfully.
12. Mandatory Ticket Information
Sellers must provide material information required for resale tickets, including information necessary for buyers to understand the ticket being purchased.
12.1 Original Face Value
Where required by applicable law, the seller must provide the original face value or amount stated on the ticket as its price accurately.
12.2 Seat or Standing Location
Where the ticket relates to a particular seat or standing area, the seller must provide the information necessary to identify that seat or area, subject to lawful security limitations.
12.3 Restrictions on Use
Any material restriction limiting use of the ticket must be disclosed, including relevant age, accessibility, supporter, identification or other attendee restrictions where applicable.
12.4 Seller Relationship Information
Where applicable law requires disclosure of a seller's relationship with an event organiser, FootyPass or another relevant party, the seller must provide accurate information about that relationship.
12.5 Material Ticket Conditions
Sellers must disclose other material information known to them that could reasonably affect a buyer's decision to purchase or ability to use the ticket.
13. Accuracy of Listings
Ticket descriptions and listing data must be truthful, accurate and sufficiently clear for buyers to understand what they are purchasing.
13.1 No False Information
A seller must not knowingly provide false or misleading information concerning a ticket, event, seat, row, section, price, restriction or delivery method.
13.2 No Fictitious Seat Information
Sellers must not invent seat numbers, row numbers or other location information. Information that has not yet been allocated must be described accurately as unallocated or to be confirmed.
13.3 Correcting Errors
If a seller discovers an error in a listing, the seller must correct it promptly. If an order has already been placed, the seller must notify FootyPass immediately.
13.4 Material Differences
A seller must not substitute a materially different ticket without disclosure and any approval required under FootyPass buyer-protection procedures.
13.5 Platform Corrections
FootyPass may correct, restrict or remove a listing where information appears inaccurate, incomplete or misleading and may request supporting evidence from the seller.
14. Seat, Stand and Section Information
Where seating or standing location information is available, it must be represented accurately and consistently with the ticket and venue information.
14.1 Stand Information
Where applicable, the seller must identify the stand or equivalent venue area associated with the ticket accurately.
14.2 Block or Section
Where available, block, section or comparable location information must correspond to the ticket being offered.
14.3 Row and Seat
Where row and seat details have been allocated and may lawfully be displayed, sellers must provide accurate information and must not substitute fictitious values.
14.4 General Admission
A general-admission or standing ticket must not be represented as providing a specific reserved seat unless it genuinely provides one.
14.5 Stadium Maps
Any stadium map or seating illustration displayed by FootyPass is intended to help users understand the venue. The ticket's actual documented location and applicable venue information remain controlling.
15. Restricted and Obstructed View Tickets
Material viewing or usage restrictions known in relation to a ticket must be disclosed clearly before purchase.
15.1 Restricted View
A ticket described by the issuer or venue as restricted view must be identified as such in the listing.
15.2 Obstructed View
Known significant visual obstructions associated with the ticket must be disclosed where that information is available to the seller.
15.3 Accessibility Tickets
Accessibility-related tickets and associated eligibility requirements must be described accurately and must not be knowingly sold to ineligible purchasers.
15.4 Supporter Restrictions
Known home-supporter, away-supporter, membership or similar admission restrictions must be disclosed where they materially affect use of the ticket.
15.5 Consequences of Non-Disclosure
Failure to disclose a material restriction may result in listing removal, buyer-protection action, payment withholding, seller-account restrictions or other remedies available under these Terms or law.
16. Ticket Quantity Rules
Ticket quantities listed or resold through FootyPass must comply with applicable law, marketplace limits and relevant event or primary-sale restrictions.
16.1 Available Quantity
A seller may list only the number of genuine tickets that the seller is entitled and able to supply.
16.2 Primary Purchase Limits
Sellers must not use FootyPass to evade lawful ticket purchase or resale quantity limits imposed by law or applicable event rules.
16.3 Platform Quantity Limits
FootyPass may impose reasonable limits on the number of tickets that may be listed, purchased or sold through an account.
16.4 Multiple Ticket Listings
Where multiple tickets are offered together, the listing must accurately state the quantity and any relevant information about whether seats are together.
16.5 Changes in Applicable Limits
Sellers must comply with statutory ticket-resale volume limits or other binding restrictions that become applicable from time to time.
17. Ticket Ownership and Authority to Sell
A seller must have a lawful basis and sufficient authority to offer every ticket listed through FootyPass.
17.1 Right to Offer the Ticket
The seller confirms that they are entitled to offer the ticket and to complete the transfer or delivery required by the listing.
17.2 Proof of Ticket
FootyPass may require reasonable evidence that a seller possesses or is entitled to receive and transfer a listed ticket.
17.3 Third-Party Tickets
A person listing on behalf of another ticket holder must have appropriate authority to do so and remains responsible for satisfying FootyPass seller obligations.
17.4 Transfer Rights
Sellers must consider applicable transfer conditions and must not represent a ticket as transferable where they know that lawful transfer is prohibited.
17.5 Loss of Authority
If a seller ceases to have the right or ability to supply a listed ticket, the listing must be removed or FootyPass notified immediately.
18. Prohibited Tickets and Listings
FootyPass prohibits listings that are fraudulent, unlawful, materially misleading or incapable of providing the admission described.
18.1 Fake or Counterfeit Tickets
Counterfeit, fabricated or otherwise fake tickets must never be listed, sold or supplied through FootyPass.
18.2 Stolen or Fraudulently Obtained Tickets
Tickets known or reasonably suspected to have been stolen, obtained through fraud or acquired through unlawful means are prohibited.
18.3 Cancelled or Invalid Tickets
A seller must not knowingly list a ticket that has already been cancelled, voided, used or otherwise made invalid.
18.4 Duplicate Sales
The same admission credential must not knowingly be sold to more than one buyer or remain listed after it has been sold elsewhere.
18.5 Unlawful Listings
FootyPass may prohibit any ticket or listing where offering, transferring or selling it would breach applicable law or a binding legal restriction.
19. Speculative Listings
FootyPass does not permit sellers to mislead buyers by offering tickets that the seller has no existing right or reasonable ability to supply.
19.1 No Fictitious Inventory
A seller must not advertise ticket inventory that does not exist merely in the hope of obtaining a ticket after a buyer places an order.
19.2 Future Ticket Issuance
Where genuine tickets have been purchased or allocated but have not yet been issued by the organiser, the listing must accurately reflect the expected delivery or transfer position.
19.3 Proof of Allocation
FootyPass may require evidence of purchase, allocation, entitlement or another legitimate basis for a listing where the ticket has not yet been issued.
19.4 Misleading Availability
Sellers must not create a false impression regarding ticket availability, scarcity, allocation or possession.
19.5 Removal of Speculative Listings
FootyPass may remove suspected speculative inventory and restrict the seller account while the listing or supporting evidence is reviewed.
20. Ticket Prices
Ticket prices must be presented transparently and must comply with applicable pricing laws, resale caps and FootyPass marketplace requirements.
20.1 Seller Listing Price
Subject to applicable law and platform restrictions, the seller specifies the price requested for the ticket when creating or updating a listing.
20.2 Face Value Information
Where required, the original face value or original ticket cost must be disclosed separately and accurately from the resale price.
20.3 Applicable Resale Price Caps
A listing must comply with any statutory resale price cap or other binding pricing restriction applicable at the time the ticket is offered or sold.
20.4 Transparent Pricing
FootyPass will present mandatory charges in accordance with applicable pricing and consumer-protection requirements so that buyers can understand the price before committing to a purchase.
20.5 Currency
Prices are displayed in the currency identified during the transaction. Currency conversion, where available, may be subject to rates or charges disclosed by the relevant payment or conversion provider.
21. Platform and Service Fees
FootyPass may charge marketplace, service or other fees where those charges are disclosed in accordance with applicable pricing requirements.
21.1 Buyer Fees
Where a mandatory buyer fee applies, FootyPass will include or disclose that charge as required so the buyer can understand the applicable purchase price.
21.2 Seller Fees
Applicable seller fees, commissions or deductions may be deducted from seller proceeds in accordance with the fee information presented to the seller.
21.3 Mandatory Charges
Mandatory charges will not intentionally be hidden or introduced in a manner prohibited by applicable consumer-protection and price-transparency rules.
21.4 Fee Changes
FootyPass may change its fee structure prospectively. Changes will not retrospectively alter fees already agreed for a completed transaction unless required or permitted by law.
21.5 Fee Transparency
Users should review the pricing information presented before confirming a purchase, listing or payout-related transaction.
22. Taxes
Taxes may apply to marketplace transactions, seller income, platform fees or other amounts depending on applicable law and the circumstances of the user.
22.1 Applicable Transaction Taxes
Where FootyPass is legally required to calculate, collect or remit a tax connected with a transaction, the relevant amount may be included or collected as required by law.
22.2 Seller Tax Responsibilities
Sellers remain responsible for understanding and meeting their own tax obligations arising from ticket sales or marketplace income except where FootyPass is legally responsible for a particular obligation.
22.3 Tax Information
FootyPass may request tax-related information where reasonably necessary to satisfy legal, reporting or payment-provider requirements.
22.4 Tax Reporting
FootyPass may report transaction, seller or payout information to tax or other competent authorities where required by applicable law.
22.5 No Personal Tax Advice
General information displayed by FootyPass does not constitute personal tax advice. Users are responsible for obtaining professional advice where appropriate.
23. Order Formation
The display of a ticket listing allows a buyer to submit a purchase request but does not by itself guarantee that an order will be successfully completed.
23.1 Submitting an Order
By submitting an order, the buyer requests to purchase the identified ticket or tickets at the price and on the terms presented during checkout.
23.2 Payment Confirmation
An order may remain pending while payment, fraud, inventory or other transaction checks are completed.
23.3 Order Acceptance
A purchase is treated as accepted when FootyPass confirms successful completion or otherwise indicates that the relevant order has been accepted.
23.4 Unavailable Inventory
If the selected ticket becomes unavailable before the transaction is completed, FootyPass may reject or cancel the attempted purchase and reverse or release any applicable payment authorisation.
23.5 Order Record
FootyPass may maintain an electronic record of the order, listing, payment status, delivery status and related transaction information.
24. Payment Processing
Ticket purchases and other monetary transactions may be processed using FootyPass payment systems and independent payment-service providers.
24.1 Payment Providers
FootyPass may use regulated or otherwise appropriate third-party payment providers to authorise, process, settle, refund or manage marketplace payments.
24.2 Supported Payment Methods
Available payment methods may vary according to currency, country, transaction type, payment provider and risk or compliance requirements.
24.3 Payment Information
Users must provide accurate payment information and must be authorised to use the payment method supplied for a transaction.
24.4 Payment Provider Terms
Use of a third-party payment service may also be subject to that provider's applicable terms, privacy notices and security procedures.
24.5 Payment Failures
FootyPass is not required to complete an order where payment cannot be authorised or processed successfully.
25. Payment Authorisation
By providing a supported payment method and confirming a transaction, the buyer authorises the applicable transaction charges to be processed.
25.1 Authority to Charge
The buyer authorises FootyPass and its payment providers to submit charges associated with the confirmed transaction.
25.2 Payment Verification
Transactions may be subject to authentication, anti-fraud, card-security or other payment-provider verification procedures.
25.3 Authorisation Holds
A payment provider may place a temporary authorisation or pending amount on a payment method before final settlement.
25.4 Declined Transactions
An order may not proceed where the issuer, payment provider or FootyPass payment controls decline or cannot authenticate the transaction.
25.5 Duplicate or Incorrect Charges
A user who reasonably believes that FootyPass has processed a duplicate or incorrect charge should contact FootyPass promptly so the transaction can be investigated.
26. FootyPass Buyer Protection
FootyPass Buyer Protection is intended to provide buyers with marketplace support where an eligible ticket is not delivered, is materially different from its listing or does not provide the promised admission.
26.1 Eligible Purchases
Buyer Protection applies only to eligible transactions completed through FootyPass and is subject to these Terms and any published Buyer Protection Policy.
26.2 Ticket as Described
An eligible buyer may report a ticket that materially differs from important information contained in the listing at the time of purchase.
26.3 Non-Delivery
A buyer may report an eligible ticket that has not been delivered or made available within the required delivery timeframe.
26.4 Invalid Ticket Claims
Where a buyer claims that a ticket was invalid or did not provide admission, FootyPass may request reasonable evidence and investigate the circumstances.
26.5 Buyer Protection Remedies
Depending on the circumstances, available remedies may include replacement tickets, a refund or another appropriate resolution. Nothing in Buyer Protection limits mandatory statutory rights.
27. Ticket Delivery
Sellers must deliver tickets using the method stated or approved for the transaction and within the applicable delivery timeframe.
27.1 Supported Delivery Methods
FootyPass may support mobile transfer, electronic delivery, downloadable tickets or other approved delivery methods depending on the event.
27.2 Seller Delivery Responsibility
The seller is responsible for supplying the correct ticket using the required delivery method and for following reasonable fulfilment instructions.
27.3 Buyer Cooperation
Buyers must reasonably cooperate with delivery, including providing accurate contact information and accepting a legitimate ticket transfer where required.
27.4 Delivery Confirmation
FootyPass may record delivery, transfer, download or fulfilment information for transaction management and dispute-resolution purposes.
27.5 Incorrect Delivery
If a seller delivers an incorrect ticket or transfer, the seller must cooperate promptly to correct the problem before the event where reasonably possible.
28. Mobile and Electronic Tickets
Many football events use electronic or mobile admission credentials. Users must handle these credentials securely and follow the applicable transfer process.
28.1 Mobile Ticket Transfers
Where a mobile transfer is required, the buyer may need to accept the ticket through an issuer, club or supported ticketing application.
28.2 Electronic Ticket Files
Electronic ticket files must correspond to the purchased admission and must not knowingly be altered in a way that affects their validity.
28.3 Dynamic Barcodes
Some tickets use rotating, dynamic or application-based barcodes. Sellers must use the correct authorised transfer method where a static copy would not provide valid admission.
28.4 Credential Security
Buyers and sellers must take reasonable steps to prevent ticket barcodes, transfer links and admission credentials from being accessed by unauthorised persons.
28.5 Required Applications
Where the event organiser requires an official application or account to receive or display a ticket, the buyer is responsible for reasonably completing the required setup.
29. Delivery Deadlines
Ticket delivery timing varies by event and ticket issuer. Some valid tickets may not be released until shortly before the scheduled event.
29.1 Expected Delivery Time
Where an expected delivery date or timeframe is provided, sellers must make reasonable efforts to deliver within that timeframe.
29.2 Late Ticket Release
A ticket is not necessarily late merely because the event organiser or primary issuer has not yet released the admission credential to the original purchaser.
29.3 Seller Notification
A seller who becomes aware of a material delivery delay should notify FootyPass promptly and provide available information concerning expected delivery.
29.4 Urgent Delivery
As an event approaches, FootyPass may contact buyers and sellers or impose additional fulfilment steps to help complete delivery in time.
29.5 Missed Delivery Deadline
Failure to deliver within an applicable final deadline may result in cancellation, buyer-protection remedies, seller-payment withholding or other action permitted under these Terms.
30. Event Changes
Football fixtures and other events may be changed by clubs, leagues, broadcasters, venues or event organisers after tickets have been listed or purchased.
30.1 Date and Time Changes
Event dates and kick-off times may change. Buyers should confirm current event information with the relevant organiser before travelling.
30.2 Venue Changes
Where an organiser changes the venue, FootyPass may update event information and apply the relevant event-change or refund rules.
30.3 Fixture Changes
Competition scheduling, broadcasting, sporting or operational decisions may cause fixtures to be moved or otherwise modified.
30.4 Ticket Validity After Changes
Where the organiser confirms that an existing ticket remains valid for the changed event, the ticket will generally continue to relate to that event subject to applicable rights and FootyPass policies.
30.5 Buyer Rights
The consequences of a material event change depend on the circumstances, organiser policy, applicable FootyPass policies and mandatory legal rights. Nothing in this section removes rights that cannot lawfully be excluded.
31. Postponed Events
This section explains how FootyPass handles tickets when an event is postponed or moved to a later date.
31.1 Meaning of Postponement
An event is postponed when it does not take place at the originally scheduled time but has not been permanently cancelled.
31.2 Validity of Existing Tickets
Tickets may remain valid for a rescheduled event where the event organiser or ticket issuer confirms that they will be honoured.
31.3 Rescheduled Event Date
Buyers should check official event information for the new date, time, venue and any revised entry requirements.
31.4 Refund Eligibility
A postponement does not automatically create a FootyPass refund. Eligibility depends on the circumstances, our Refund Policy and any rights available under applicable law.
31.5 Seller Obligations After Postponement
Sellers must continue to cooperate with ticket delivery, replacement or refund procedures where required and must not dispose of tickets that remain subject to an existing FootyPass order.
32. Cancelled Events
Where an event is cancelled, FootyPass will assess affected orders using confirmed information from the organiser, issuer or other reliable sources.
32.1 Confirmation of Cancellation
FootyPass may wait for reliable confirmation that an event has been cancelled before applying cancellation remedies.
32.2 Buyer Remedies
Buyers may qualify for a refund or other remedy under the FootyPass Refund Policy and applicable consumer law.
32.3 Seller Responsibilities
A seller must cooperate with FootyPass following cancellation and provide information concerning any refund, credit or other remedy received from the original ticket issuer.
32.4 Seller Payment Reversal
FootyPass may withhold, reverse or recover seller proceeds associated with a cancelled event where this is reasonably necessary to provide an eligible buyer remedy.
32.5 Replacement or Rescheduled Events
An event moved to another date or venue is not necessarily treated as cancelled. FootyPass will consider the organiser's official decision and applicable buyer rights.
33. Refunds
Refunds are governed by these Terms, the FootyPass Refund Policy and any mandatory rights available under applicable consumer law.
33.1 Eligible Refund Claims
A refund may be available for qualifying cancellation, non-delivery, invalid tickets, materially inaccurate listings or another circumstance covered by FootyPass Buyer Protection.
33.2 Change of Mind
A buyer is not automatically entitled to cancel merely because they change their mind. Nothing in this clause limits a cancellation or refund right that cannot lawfully be excluded.
33.3 Submitting a Refund Request
Buyers must provide requested order information and reasonable supporting evidence so FootyPass can investigate the claim.
33.4 Refund Method and Timing
Approved refunds will normally be returned through the original payment method where reasonably possible. Processing time may depend on banks and payment service providers.
33.5 No Double Recovery
A buyer must not obtain multiple reimbursements for the same loss. FootyPass may take into account refunds, chargebacks, insurance payments or other compensation already received.
34. Failed Entry
FootyPass Buyer Protection may apply where a buyer is refused entry because a ticket supplied through FootyPass is invalid or materially defective.
34.1 Reporting Failed Entry
The buyer should contact FootyPass as soon as reasonably possible after being refused entry and explain what occurred.
34.2 Evidence of Refused Entry
FootyPass may request screenshots, ticket records, venue communications, photographs or other reasonable evidence supporting a failed-entry claim.
34.3 Ticket-Related Entry Failure
Protection may apply where entry fails because the supplied ticket was invalid, duplicated, cancelled or materially different from the listing.
34.4 Buyer-Related Entry Failure
Protection may not apply where entry was refused because of the buyer's conduct, lateness, failure to meet properly disclosed entry conditions or breach of venue rules.
34.5 Investigation and Resolution
FootyPass may obtain information from the buyer, seller, ticket issuer or other relevant parties before determining an appropriate remedy.
35. Invalid or Duplicate Tickets
Sellers must never knowingly supply invalid, cancelled, fraudulent or duplicated tickets through FootyPass.
35.1 Invalid Tickets
A ticket may be treated as invalid where it cannot legitimately be used for entry to the event for which it was sold.
35.2 Duplicate Tickets
A seller must not provide the same ticket, barcode or unique entry credential to more than one buyer where only one entry is permitted.
35.3 Seller Responsibility
The seller is responsible for ensuring that tickets supplied through an order are genuine, usable and consistent with the listing.
35.4 Buyer Remedies
Where an invalid or duplicate ticket causes a qualifying loss, FootyPass may provide a replacement, refund or other remedy under Buyer Protection.
35.5 Enforcement Against Sellers
FootyPass may withhold earnings, reverse payments, restrict listings, suspend accounts or take other proportionate action where invalid or duplicate tickets are supplied.
36. Seller Earnings
Seller earnings represent amounts payable to a seller from completed transactions after applicable fees, adjustments and deductions.
36.1 Calculation of Earnings
FootyPass calculates seller earnings using the transaction value, applicable seller fees, adjustments, refunds and other authorised deductions.
36.2 Pending Earnings
Seller earnings may remain pending until relevant delivery, event, fraud-prevention and buyer-protection requirements have been satisfied.
36.3 Earnings Adjustments
FootyPass may correct an earnings record where a calculation error, refund, cancellation, dispute or other legitimate adjustment occurs.
36.4 Currencies
Earnings are recorded in the currency shown for the transaction. Currency conversion may be subject to payment-provider rates and charges.
36.5 Seller Records
Sellers should review their transaction and wallet records and notify FootyPass promptly if they reasonably believe an earnings entry is incorrect.
37. Seller Payment Holds
FootyPass may temporarily hold seller funds where reasonably necessary to manage transaction, fraud, refund, chargeback or compliance risks.
37.1 Reasons for a Hold
A hold may arise from an unresolved delivery issue, buyer complaint, event cancellation, fraud review, chargeback or compliance investigation.
37.2 Duration of Holds
A hold will remain only for as long as reasonably necessary to investigate or address the issue giving rise to it, subject to applicable law.
37.3 Requests for Evidence
A seller may be required to provide proof of purchase, ticket validity, delivery information, identity information or other relevant evidence.
37.4 Deductions From Held Funds
Where permitted by these Terms and applicable law, amounts properly owed because of refunds, chargebacks or seller liabilities may be deducted from funds otherwise payable to the seller.
37.5 Release of a Hold
Eligible funds will be released when FootyPass determines that the reason for the hold has been resolved and applicable payout conditions are met.
38. Seller Payouts
Eligible seller balances may be paid to a verified payout method supported by FootyPass and its payment providers.
38.1 Payout Eligibility
Only available seller balances that are not subject to a valid hold, dispute or other restriction are eligible for payout.
38.2 Verified Payout Details
Sellers are responsible for supplying accurate payout information and completing any verification required by FootyPass or a payment provider.
38.3 Payout Processing
Payout requests may require processing time. Bank, payment-provider and compliance checks may affect when funds are received.
38.4 Payout Fees and Currency
Any applicable payout or currency-conversion charge will be disclosed where required before it is imposed.
38.5 Failed or Returned Payouts
If a payout fails or is returned, FootyPass may restore the relevant balance after reconciliation and request corrected payout information.
39. Chargebacks and Payment Disputes
FootyPass may investigate and respond to chargebacks, payment reversals and other disputes relating to marketplace transactions.
39.1 Chargeback Notification
Where appropriate, FootyPass may notify an affected seller that a transaction is subject to a chargeback or payment dispute.
39.2 Supporting Evidence
Users must provide reasonably requested information that may assist with a payment dispute, including delivery or ticket-validity records.
39.3 Temporary Holds
FootyPass may place a reasonable temporary hold on related seller funds while a chargeback or payment dispute remains unresolved.
39.4 Financial Adjustments
Following resolution, FootyPass may make appropriate wallet or ledger adjustments reflecting refunds, reversals or amounts properly payable.
39.5 Chargeback Abuse
Users must not knowingly submit false, duplicate or abusive payment disputes. Suspected abuse may result in investigation or account restrictions.
40. Fraud Prevention and Abuse
FootyPass may use proportionate measures to detect, prevent and investigate fraud, account abuse and unlawful activity.
40.1 Transaction Monitoring
Transactions and account activity may be reviewed for patterns reasonably associated with fraud, abuse or security threats.
40.2 Additional Verification
FootyPass may request additional identity, payment, ticket or transaction verification where reasonably necessary.
40.3 Protective Restrictions
FootyPass may temporarily restrict transactions, listings or payouts while reasonably investigating suspected fraudulent activity.
40.4 Reporting Unlawful Activity
FootyPass may report suspected criminal activity where required or permitted by law and may cooperate with competent authorities.
40.5 Consequences of Fraud
Confirmed fraud may result in cancellation of listings, payment reversals, account termination and other lawful protective action.
41. Prohibited Conduct
Users must use FootyPass lawfully, honestly and in a manner that does not harm other users, events or the operation of the marketplace.
41.1 Fraudulent Activity
Users must not commit fraud, use stolen payment methods, submit false claims or knowingly provide false information.
41.2 Automated Purchasing Abuse
Users must not use unlawful automated purchasing tools or otherwise circumvent ticket purchase limits in breach of applicable law.
41.3 Marketplace Manipulation
Artificial transactions, coordinated manipulation, fake demand and attempts to distort marketplace information are prohibited.
41.4 Harassment and Abuse
Threatening, abusive, discriminatory or harassing conduct toward users, staff or marketplace participants is prohibited.
41.5 Circumvention of Controls
Users must not deliberately bypass account restrictions, verification requirements, security controls or other lawful platform safeguards.
42. Reviews and Ratings
FootyPass may provide reviews and ratings to help users make informed marketplace decisions.
42.1 Verified Reviews
FootyPass may restrict reviews to users connected with eligible transactions so that reviews reflect genuine marketplace experiences.
42.2 Honest Reviews
Reviews must reflect the reviewer's genuine experience and must not contain knowingly false or misleading statements.
42.3 Review Moderation
FootyPass may moderate or remove reviews that violate platform rules, applicable law or reasonable content standards.
42.4 Fake or Manipulated Reviews
Creating, purchasing, coordinating or incentivising misleading reviews or ratings is prohibited.
42.5 Seller Responses
Where seller responses are supported, sellers must respond professionally and must not disclose unnecessary personal information.
43. Intellectual Property
FootyPass and third parties retain their respective rights in trademarks, software, content, designs, databases and other protected materials.
43.1 FootyPass Rights
FootyPass branding, original software and original platform content may not be copied or commercially exploited without permission.
43.2 User Content Licence
Where users submit content needed to operate the marketplace, they grant FootyPass a limited licence to host, display and process that content.
43.3 Third-Party Rights
Club badges, competition marks, photographs and other third-party materials remain subject to the rights of their respective owners.
43.4 Prohibited Use
Users must not reproduce, scrape, distribute or commercially exploit protected FootyPass content except where authorised or permitted by law.
43.5 Rights Complaints
Rights holders may contact FootyPass regarding allegedly infringing material, and FootyPass may investigate and remove material where appropriate.
44. Third-Party Services
FootyPass may depend on external providers for payments, communications, hosting, identity verification and other marketplace functions.
44.1 Payment Providers
Payment and payout services may be performed by third-party providers and may be subject to their lawful requirements.
44.2 External Links
Links to external websites are provided for convenience or information and do not necessarily constitute endorsement by FootyPass.
44.3 Event Organisers and Venues
Event organisers, clubs and venues are independent third parties unless FootyPass expressly states otherwise.
44.4 Third-Party Availability
External services may occasionally be unavailable or delayed for reasons outside FootyPass's reasonable control.
44.5 Third-Party Terms
Users may need to comply with separate lawful terms imposed by payment providers, ticket issuers, venues or other third parties.
45. Account Suspension and Termination
FootyPass may restrict, suspend or terminate accounts where proportionate and reasonably necessary to protect users, the marketplace or legal compliance.
45.1 Grounds for Suspension
Grounds may include suspected fraud, serious policy breaches, security risks, repeated transaction failures or legal requirements.
45.2 Temporary Restrictions
FootyPass may temporarily limit selling, purchasing, withdrawal or payout functionality while an issue is investigated.
45.3 Termination
Serious or repeated breaches may result in account termination where lawful and proportionate in the circumstances.
45.4 Outstanding Transactions and Balances
Suspension or termination does not automatically remove legitimate obligations arising from existing orders, refunds, disputes or balances.
45.5 Review of Restrictions
Where appropriate, a user may contact FootyPass support to request review of an account restriction and provide relevant information.
46. Complaints and Dispute Resolution
FootyPass aims to investigate marketplace complaints fairly and provide users with a practical process for resolving eligible disputes.
46.1 Contacting Support
Users should first contact FootyPass support and provide the relevant order reference and a clear description of the issue.
46.2 Information Required
FootyPass may request reasonable documents, screenshots, correspondence or other information required to investigate a complaint.
46.3 Investigation
FootyPass may review transaction records and obtain information from relevant buyers, sellers and service providers.
46.4 Proposed Resolution
Depending on the circumstances, FootyPass may propose a refund, replacement, correction, account adjustment or other appropriate outcome.
46.5 External Rights
Nothing in the internal complaints process removes any mandatory right a consumer has to seek assistance or pursue a claim through an appropriate external body or court.
47. Liability
This section describes the allocation of responsibility between FootyPass and its users, subject at all times to rights and liabilities that cannot lawfully be excluded.
47.1 Non-Excludable Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that applicable consumer law requires to remain available.
47.2 Marketplace Role
Where FootyPass acts as a secondary marketplace, sellers remain responsible for the tickets they list and the information they provide.
47.3 Foreseeable Loss
Where FootyPass is legally responsible to a consumer, liability will be determined in accordance with applicable law, including rules concerning reasonably foreseeable loss.
47.4 Business Users
To the extent permitted by law, different limitations may apply to users acting wholly or mainly for business or professional purposes.
47.5 Events Outside Reasonable Control
FootyPass is not responsible for an event organiser's independent decisions or other matters outside FootyPass's reasonable control, except where applicable law provides otherwise.
48. Indemnity
Where permitted by applicable law, certain users may be responsible for losses directly caused by their unlawful use of FootyPass or serious breach of these Terms.
48.1 Seller Breaches
A seller may be responsible for direct losses arising from knowingly fraudulent tickets, unauthorised listings or other serious seller breaches.
48.2 Third-Party Claims
Responsibility may arise where a user's unlawful conduct directly causes a valid third-party claim against FootyPass.
48.3 Reasonable Losses
Any claim under this section is limited to losses that may lawfully be recovered and that are reasonably connected with the relevant breach.
48.4 Duty to Mitigate
FootyPass will take reasonable steps to avoid or reduce losses where the law requires or expects such mitigation.
48.5 Consumer Rights Preserved
This indemnity does not remove, reduce or override mandatory consumer protections or impose liability where doing so would be unfair or unlawful.
49. Governing Law and Jurisdiction
These Terms are intended to operate consistently with applicable UK law while preserving mandatory rights available to consumers.
49.1 Governing Law
Subject to mandatory consumer protections, these Terms are governed by the laws of England and Wales.
49.2 Consumer Protections
Consumers retain any mandatory protections provided by the law that applies to them and which cannot lawfully be excluded by contract.
49.3 Courts
Disputes may be brought before courts having jurisdiction under applicable law. These Terms do not unlawfully restrict a consumer's right to use an available competent court.
49.4 Informal Resolution
Users are encouraged to contact FootyPass first so that disputes can, where possible, be resolved without formal proceedings.
49.5 Mandatory Law
Where a provision of these Terms conflicts with a mandatory legal requirement, the mandatory requirement prevails to the extent of the conflict.
50. Changes to These Terms
FootyPass may update these Terms where reasonably necessary to reflect changes to the marketplace, services, security requirements or applicable law.
50.1 Reasons for Changes
Changes may be made to address new functionality, legal requirements, security concerns, marketplace practices or improvements to user protection.
50.2 Notice of Material Changes
Where appropriate, FootyPass will provide reasonable notice of material changes through the platform, email or another suitable method.
50.3 Effective Date
Updated Terms will identify or otherwise communicate when they take effect and will generally apply prospectively.
50.4 Existing Transactions
Changes will not retrospectively remove rights already acquired under an existing transaction where doing so would be unlawful.
50.5 Continued Use
Continued use of FootyPass after updated Terms take effect may constitute acceptance where permitted by law. Mandatory consumer rights remain unaffected.
